Terms & Conditions
1. All estimates and material takeoffs are prepared solely based on the drawings, specifications, and documents provided by the Client.
2. Material and labor pricing included in our estimates is based on current market conditions and pricing databases available at the time of preparation. Prices are subject to market fluctuations, and clients are responsible for verifying pricing before submitting bids.
3. Any trade, item, material, or scope not specifically included in the estimate shall be considered excluded unless otherwise stated in writing.
4. Our material takeoffs are based on scaled PDF drawings unless otherwise noted.
5. Any revisions resulting from changes in drawings, specifications, addenda, project scope, or client instructions after work has commenced shall be treated as additional work and may incur additional charges.
6. Completion of bid forms, value engineering, alternates, substitutions, RFIs, procurement assistance, bid revisions, or any services beyond the original agreed scope will be quoted and charged separately unless otherwise stated in writing.
7. Payment requirements vary by project and will be communicated to the Client before work commences. Legacy Estimating reserves the right to suspend, delay, or decline work until the agreed payment has been received.
8. Unless otherwise agreed in writing, all remaining project drawings, revisions, or required project information must be submitted within 30 calendar days of proposal acceptance or payment. Failure to do so may result in the remaining scope being cancelled, repriced, rescheduled, or declined at the sole discretion of Legacy Estimating. No refund, credit, or project substitution shall apply unless approved in writing by Legacy Estimating.
9. Payments made for work already performed are non-refundable. Credits, refunds, or project substitutions are not guaranteed and will only be considered at the sole discretion of Legacy Estimating.
10. An approved project may not be substituted with another project without the prior written approval of Legacy Estimating. Any approved substitution may be subject to revised pricing, a project swapping fee, administrative charges, or other applicable fees.
11. Estimated turnaround times commence only after all required drawings, specifications, and project information have been received. Delays in receiving project information or revisions may extend the estimated delivery schedule.
12. Clients are responsible for reviewing all deliverables before submitting bids. Legacy Estimating shall not be responsible for omissions or inaccuracies resulting from incomplete, inaccurate, superseded, or conflicting drawings, specifications, or information provided by the Client.
13. Legacy Estimating reserves the right to revise pricing and turnaround times where revised drawings, additional addenda, or material changes to the project scope significantly affect the original estimate.
14. Estimates, takeoffs, markups, spreadsheets, and supporting documents are prepared solely for the Client's use on the specific project for which they were commissioned and may not be resold, redistributed, or reproduced for commercial purposes without the prior written consent of Legacy Estimating.
15. Legacy Estimating's maximum liability for any claim arising out of its services shall not exceed the amount paid by the Client for the specific project giving rise to the claim.
16. By approving a proposal, making payment, requesting commencement of work, or continuing to use Legacy Estimating's services, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
